Terms of Service

Agreement

These terms apply to every quote, order, online store and service from The POSER Company LLC ("POSER," "we," "us"). By approving a quote, placing an order or using posercompany.com, our client stores or POSER Tools, you agree to them. A signed proposal or contract with different terms controls where it conflicts with these.

Quotes and pricing

  • Quotes are valid for 30 days unless the quote says otherwise.
  • Prices are based on the quantities, garments, decoration methods, sizes and locations listed. Changes to any of these may change the price.
  • One-time charges, such as setup, screens and digitizing, are billed once per design and are not refundable after production starts.
  • Taxes and shipping are not included unless stated.

Art proofs and approval

  • Production starts only after you approve the art proof in writing. Approval locks the artwork, quantities, sizes, colors and pricing.
  • Please check spelling, colors, placement and sizes carefully. You are responsible for errors in an approved proof.
  • Colors on screen are a close simulation. Garment and ink colors can vary slightly by dye lot and material. Embroidery is shown as a stitch interpretation, and placement may vary up to 1/4 inch.
  • Mockups and lifestyle images are illustrations, not exact photographs of the finished product.

Your artwork and our designs

  • You confirm that you own or have permission to use every logo, trademark, image and text you send us, and you agree to cover any claim that it infringes someone else's rights.
  • Designs, mockups and proofs created by POSER remain POSER's property until the related order is paid in full. Using them without an order or our written permission is not allowed.
  • We may decline any artwork we believe is unlawful, infringing or offensive.

Payment

  • Payment terms are stated on your quote or invoice. We may require a deposit or full payment before production.
  • Late balances may delay future orders, and we may hold shipments until the account is current.

Production, quantities and shipping

  • Production times start after proof approval and payment, and are estimates, not guarantees, unless agreed in writing as a firm in-hands date.
  • Decorated goods can run slightly over or under the ordered quantity (up to 5 percent). We bill for the quantity delivered.
  • Blank garments and products depend on supplier stock. If an item becomes unavailable, we will offer the closest match or adjust the order with your approval.
  • Risk of loss passes to you when the carrier picks up the shipment. We will help file claims for lost or damaged packages.

Changes, cancellations and returns

  • Orders can be changed or cancelled without charge until the proof is approved. After approval, costs already incurred (blanks, setups, labor) are billed.
  • Custom decorated products cannot be returned or exchanged for size, preference or ordering errors.
  • If an item arrives defective or decorated in error by us, tell us within 7 days of delivery with photos. We will reprint, replace or credit the affected items, at our choice. This is your sole remedy for defective goods.

Online stores

Stores we run for organizations follow these terms plus any rules shown in that store, such as eligibility, codes, points or limits set by the organization. Store pricing, availability and products may change at any time.

POSER Tools

POSER Tools is for authorized users only. Do not share your access, copy pricing or cost information, or use the tools to build a competing service. We may suspend access at any time.

Limitation of liability

To the extent the law allows, our total liability for any claim is limited to the amount you paid for the order involved, and we are not liable for indirect, incidental or consequential damages, including lost profits or missed event dates.

Governing law

These terms are governed by the laws of the State of Georgia. Any dispute will be resolved in the state or federal courts serving Fulton County, Georgia.
